Episode 4: The Long and Bloody Revolution

Since 1982, Canadians have been increasingly crushed under the Charter of Rights and Freedoms as the supreme law of the land. As we approach the 40th birthday of our nebulously-written constitution, we take stock of the results of a revolutionary change of the guard. No longer is parliament the key institution where laws are written or debated, as that responsibility has been usurped behind closed doors by the un-elected Supreme Court of Canada, thanks to the Charter. How did this dramatic shift in power occur? We look to Gwendolyn Landolt et al. in their incredible exposé “From Democracy to Judicial Dictatorship in Canada: The Untold Story of the Charter of Rights,” for some answers. We zero in on the sections of the Charter which have led the Supreme Court to create new and radical law in their un-elected role as judicial activists. Original air date: April 26, 2020. Running Time: 57 minutes.
